促外贸企业稳定发展!沪出台11项支持措施(内含中英文)

 

为进一步发挥外贸企业在疫情防控中的作用,切实减轻疫情对外贸企业生产经营影响,经市政府同意,市商务委发布《关于应对新冠肺炎疫情支持外贸企业稳定发展的政策措施》,推出优化重点防控物资进口采购机制、支持企业妥善安排复工运营、加大对外贸企业的融资支持、优化通关监管服务等11项政策措施。该文件自公布之日起施行。详↓

一、优化重点防控物资进口采购机制

全力保障进口药品、消毒物品、防护用品、救治器械等防控物资快速通关,完善相关绿色通关机制。建立防疫防控物资进口单位名单和进口物资清单,对卫生健康主管部门组织进口的直接用于防控疫情物资免征关税;对已征收的应免税款,进口企业可于2020年9月30日前申请退还。疫情结束后,对进口防控医用物资经统筹调配后仍有剩余的,按规定程序统筹纳入市级物资储备体系消化。对指定采购品种和数量的进口民用防控物资,企业继续销售后确实难以处置的,按规定程序研究纳入市级储备商品体系消化。

二、支持企业妥善安排复工运营

加大企业复产用工保障力度,积极帮助企业协调解决防疫物资需求。支持港务、集卡运输等外贸服务行业优先复工,确保重点企业供应链安全。企业因受疫情影响导致生产经营困难的,可通过与职工协商一致采取调整薪酬、轮岗轮休、缩短工时等方式稳定工作岗位。支持企业通过省际包车方式组织员工返沪。

三、加大对外贸企业的融资支持

鼓励在沪金融机构加大对疫情防控重点外贸企业的支持,在综合评估企业资金需求、市场供需等因素,切实防范信贷风险的前提下,提供优惠利率贷款,满足企业合理资金需求。对受疫情影响较重、有发展前景但暂时受困的外贸企业,通过变更还款安排、延长还款期限、无还本续贷等方式予以支持。支持中信保上海分公司与银行、市政策性融资担保基金加强保单融资合作,发挥分险增信的贸易融资促进作用,并将保单融资覆盖范围从年出口500万美元以下的企业扩大到3000万美元(含)以下。市政策性融资担保基金对防疫物资保障和受疫情影响较大的重点外贸企业加大融资担保支持力度,在疫情防控期间对相关企业新申请贷款的融资担保费率降至0.5%/年,再担保费率减半收取。

四、优化通关监管服务

对企业复工复产急需进口的原材料、零部件、机器设备等产品设立通关“绿色通道”。对因疫情影响,产生的企业延迟交货、退换货等情况,及时办理手续,提供相关便利;导致的报关单修撤,不记录报关差错。企业开展分送集报、集中内销、深加工结转、保税展示交易等业务时,申报时限可在原来基础上顺延1个月。本市疫情防控期间,对加工贸易企业(含海关特殊监管区域内企业),因防疫需要延迟复工造成加工贸易手(账)册超过有效期(核销周期)的,可延期办理,事后补充提交有关材料。加工贸易手(账)册项下深加工结转、内销征税等各类申报业务超过规定时限的,可延期办理相关手续。

五、进一步发挥信用保险作用

完善政府、信保及商协会合作机制,中信保上海分公司进一步加大承保力度,对有需求的订单、有潜力的企业做到应保尽保。开展疫情防控物资进口预付款保险业务,放宽承保条件,免除对海外供应商的资信服务收费,免费提供海外供应商目录和提单报告。优先处理受疫情影响企业的出险理赔,在贸易真实性无疑点前提下,重点核实贸易背景及债权金额,适当放宽理赔条件,先行启动定损核赔程序。进一步加强重点企业政策性资源配置支持,并推广出运前出口信用保险服务,保障企业因买方以疫情为由取消合同的风险。

六、支持企业调整境外参展计划

对本市疫情防控期间,不能赴境外参展并已发生展位费用的企业,可继续享受本市境外参展相关支持政策。帮助因疫情无法出国参展的企业协调国内外组展机构,妥善处理已付费用等相关问题。

七、支持企业开拓国际市场

支持企业积极利用跨境电商平台,加大国际市场开拓力度,扩大全球采购规模。发挥企业国际营销体系公共服务平台作用,延长贸易供应链。鼓励企业充分发挥网上广交会平台作用,引导企业及时调整贸易促进活动,维持并扩大国际市场客户和销售渠道。

八、优化跨境金融结算服务

外贸企业进口卫生防疫、医疗用品等疫情防控物资的,可按照特事特办原则,由本市银行注明“疫情防控”,简化进口购付汇业务流程和材料直接办理购付汇手续。外贸企业申请贸易外汇收支企业名录登记的,可在办理对外贸易经营者备案登记后,直接登录“数字外管”平台在线申请,实现一网通办,无需现场核验,办理时间压缩到1个工作日内。无捐赠外汇账户的境内受赠机构,接受来自境内外涉及此次疫情的外汇捐赠资金的,无需新开立捐赠外汇账户。便利疫情防控相关的跨境投融资业务,外贸企业可按规定简化和线上办理各项资本项目外汇业务。与疫情防控有关的其他特殊外汇业务,可由本市银行先行办理,事后报备。

九、推进进出口许可备案事项办理无纸化

积极引导和鼓励企业通过无纸化方式申领进出口许可证件。对于内容较多、文本较大的进出口合同,企业可只上传涉及进出口许可证申领信息的合同关键页。全面扩大电子原产地证书签发和自主打印服务范围。

十、完善国际贸易“单一窗口”功能

上海国际贸易“单一窗口”上线境外物资捐赠系统,整合优化捐赠受理和海关免税业务办理流程。推进纳入进口消毒产品的卫生安全评价报告备案功能。开通中小外贸企业服务专窗,便利企业不见面办理通关、物流、金融等一揽子进出口业务。通过国际贸易全链条信息数据归集,便利银行保险机构开展贸易背景审核,提升企业获得贷款便利度,提供优惠信贷、跨境汇款、融资等绿色通道服务。加强信用保险线上系统服务,上年出口额500万美元以下(含)小微企业,可登陆上海国际贸易“单一窗口”办理投保、续转、理赔和融资服务。

十一、加大涉外法律援助和咨询服务力度

对于企业受疫情影响造成的合同履行、劳资关系等纠纷,及时提供咨询、指引、调解服务。鼓励仲裁机构、司法鉴定机构对受疫情影响较严重企业的案件优先受理、加速办理。公证机构优先为涉疫情的相关事务提供公证法律服务,为防疫重点企业减免相关事项的公证服务费用。对企业因疫情引发的贸易合同纠纷,支持企业向贸易促进机构和全国性行业组织申请出具相关事实证明。鼓励国际贸易纠纷当事人、代理人优先选择互联网或邮寄送达方式提交仲裁、调解申请。支持企业开展国际经贸法律风险及合规评估,加强对国际经贸政策和法律实践的追踪,定期通过公共平台发布,提前发布预警信息。

Policy Measures to Support the Steady Development of Foreign Trade Companies  in Response to COVID-19

To thoroughly implement the instructions of Mr. Xi Jinping, General Secretary of the Communist Party of China, on maintaining stable fundamentals of foreign trade and to carry out the decisions and deployment made by the CPC Central Committee and the State Council on the coordinated epidemic prevention and control as well as the socio-economic development, the following policy measures are formulated and approved by Shanghai Municipal People’s Government to give full play to the role of foreign trade companies in epidemic prevention and control as well as reduce the impact of the epidemic on production and operation of foreign trade companies: 

I. The mechanism for import of key medical supplies will be optimized.

Dedicated efforts are made to secure fast customs clearance and to improve on the green access for import of medical supplies needed in the fight against COVID 19, which include drugs, disinfectants, protective products, medical equipment, and etc. Lists of importers and medical supplies used in the epidemic prevention and control are formed. Medical supplies directly used in the epidemic prevention and control as well as imported under the instruction of the health authority are exempted from import duty; previous levies will be refunded before September 30th of 2020 upon application of importers. In the post-epidemic period, the residual imported medical supplies, if any, will be included in municipal-level strategic reserve system following established procedures. The imported products of designated categories and volume for civilian use in the epidemic prevention and control, with expressed and verified difficulty in sales on the part of importers, will be taken over as municipal-level strategic commodity reserves following the prescribed procedures. II. Full support will be given to companies’ resumption of work and operation. 

Shanghai will scale up its efforts to improve labor availability for companies’ resumption of operation and will actively coordinate supplies for companies to combat the epidemic. Priority support will be given to port-related and container truck transportation companies for their restoration of operation in a bid to maintain supply chain security for key enterprises. Companies facing difficulties in production and operation due to the epidemic are encouraged to negotiate with staffs to stabilize employment by adopting salary adjustment, working in shifts, shortened work hours and other approaches. Companies are encouraged to organize employees to return to Shanghai by inter-provincial chartered bus. III. Stronger financing support will be given to foreign trade companies.

Financial institutions in Shanghai are encouraged to provide greater support to foreign trade companies playing key roles in the epidemic prevention and control by offering concessional loans to satisfy their reasonable capital needs based on credit risk aversion as well as comprehensive assessment on factors such as enterprises’ funding gap and market supply and demand. For the hard-hit foreign trade companies with prospects of returning to profitable operations, support will be given by adjusting debt repayment schedule, extending repayment period and renewing loans without the repayment of principal among others. The Shanghai Branch of China Export and Credit Insurance Corporation is supported to enhance cooperation with banks and Shanghai Policy Financing Guarantee Funds on policy-backed financing, giving full play to the role of risk diversification and credit enhancement in promoting trade financing. And the policy-backed financing will benefit a wider audience by lifting the previous annual export volume ceiling from USD 5 million to USD 30 million. Shanghai Policy Financing Guarantee Funds will better support foreign trade enterprises that have played key roles in guaranteeing medical supplies and have suffered huge impact by the epidemic. During the epidemic period, the rate of fees for financing guarantee for new loan applications is to be reduced to 0.5% per year and the re-guarantee fee will be cut by half. IV. Regulatory services for customs clearance will be optimized. 

A “green access” for customs clearance will be put in place to facilitate the imports of materials, parts, equipment and other products urgently needed by enterprises in their resumption of work and production. In terms of the delayed delivery of goods, refund requests or return of goods incurred by the epidemic, relevant authorities should provide convenience for enterprises in a timely manner. The alteration and withdrawal of customs declaration manifests caused by the epidemic will not be recorded as an error. When processing formalities for affairs such as centralized customs declaration for multiple batches of goods, consolidated sell back, deep processing transit and bonded exhibition and transaction, enterprises will see the time limit for declaration extended by an extra month. During the epidemic prevention and control period in Shanghai, processing trade companies (including the companies in the customs special supervision areas) that experience expiration of their manual of processing trade (or account book is overdue for verification) due to the delay in work resumption incurred by the epidemic can go through formalities and submit related materials afterwards. The customs declaration for deep processing transit, tax payment of goods for domestic sales and other businesses under the processing trade manual (account book), if exceeding the prescribed time limit, can be postponed. V. Credit insurance will play a bigger role. 

Efforts will be made to improve cooperation mechanism among governments, credit insurance institutions and business associations. The Shanghai branch of China Export and Credit Insurance Corporation will enhance its underwriting capacity and provide, to the best of its capabilities, insurance for orders that are real as and for companies with potential. Insurance for the advance payment of imported supplies should be in place with relaxed insurance conditions. The service charge of credit reporting for foreign suppliers will be exempted and a catalog of overseas suppliers and report of bill of lading should be offered free of charge. Priority will be given to the claims made by hard-hit companies. Under the premise of trade authenticity, primary attention will be given to the verification of the trade background and liability level. Terms of claim settlement will be reasonably eased with prioritized initiation of loss assessment and compensation appraisal procedures. The allocation of policy resources will further pivot to key enterprises. Pre-shipment export credit insurance service will be promoted to safeguard companies against the risk of contract cancellation initiated by buyers referencing epidemic influence. vi. Support will be given to businesses in adjusting their plans for overseas trade Show participation. 

During the prevention and control period in Shanghai, enterprises that have already paid booth fees but won’t be able to attend will continue to be eligible for Shanghai’s supporting policies for businesses attending overseas trade shows. Exhibitors that are unable to attend overseas trade shows due to the epidemic will be assisted in reconciling with domestic and international organizers on issues such as prepaid fees. vii. Support will be given to businesses to enhance their presence in the international market

Enterprises will be supported to actively utilize cross-border e-commerce platforms to extend their reach in the international market and expand their scale of sourcing worldwide. We will play to the strength of enterprises accredited as Public Service Platforms for International Marketing and forge longer trade supply chains. Enterprises will also be encouraged to fully utilize the online platform of the China Import and Export Fair and will be guided to adjust their promotional events as well as maintain and enlarge international client base and sales channels. viii. The cross-border financial settlement services will be optimized

International trade companies that import epidemic prevention and control supplies are applicable to measures for extraordinary cases, which entails a marking of “Epidemic Prevention and Control” by local banks as well as streamlined procedures for purchasing and payment of foreign exchanges. Applicants for the registration of Company Name List for Foreign Exchange Account Balance for Trade, after being registered as International Trade Operators, can access the ASOne platform for online registration which will be completed in one working day with no physical presence needed. For domestic receiver institutions without foreign exchange accounts for donation, there is no need to open a new one for the reception of epidemic-related funding donation in foreign exchanges form from home and abroad. Cross-border financing activities pertaining to epidemic prevention and control will be facilitated. International trade companies are allowed to handle their foreign exchange-related businesses under capital account online with streamlined procedures. Other special epidemic-linked foreign exchange businesses can be handled by Shanghai’s banks first with Ex-post case filing. (State Administration of Foreign Exchange Shanghai Bureau)         

ix. Paperless filing for import and export permits will be implemented.

Enterprises will be actively guided and encouraged to apply for Import and Export Permit online. For contracts with excessive contents and constituting big files, enterprises are allowed to only upload key pages pertinent to the permit application. x. Functions of the China (Shanghai) International Trade Single Window will be optimized. 

The China (Shanghai) International Trade Single Window just launched a new interface to process, with higher efficiency, the clearance for overseas donations . For imported disinfection products, a new function that allows filing for health and safety assessment report will be implemented in the system. A special service window will be opened exclusively for the SMEs, allowing them to process all the import and export-related businesses such as clearance, logistics and finance without physical presence. With the panoramic data of international trade chain collected through the system, it will be more convenient for the banks and insurers to conduct background checks on trade, thus making loans more accessible to the enterprises with green access services being provided, such as concessional loans, cross-border money transfer and financing. The online services for credit insurance will be enhanced. SMEs with under USD 5 million export volume in the previous year can login on the China (Shanghai) International Trade Single Window to process businesses such as policy purchasing, policy renewal and conversion, claim as well as financing. xi. There will be enhanced accessibility of overseas legal assistance and counseling.

Timely counseling, guidance and mediation services will be offered to companies involved in disputes caused by the epidemic over contract implementation, labor and financial matters. Arbitration institutions and judicial authentication institutions are encouraged to give priority to the expedited handling of cases that involve companies seriously affected by the epidemic. The notary agencies shall give priority to requests that are related to the epidemic and reduce/exempt notary fees for key enterprises for the prevention and control of the epidemic. For trade contract disputes, companies in question will be supported to request proof from trade promotion agencies and national industry associations. The litigants and agents in international trade disputes are encouraged to file application for adjudication and mediation through mail and online channels. Enterprises are also encouraged to carry out legal and compliance risk assessments on international trade. The tracking of international trade policies and legal practices will be intensified with periodic releases of relevant information and issuance of risk alert through public platforms.   

Shanghai will continue to implement all the supporting policies made by the central government. The line departments and agencies are responsible for making detailed implementation plans for each policy measure, which will be enforced by district governments. The validity period of this policy extends from the date of issuance to December 31st 2020. (In case of clearly specified validity periods for particular provisions which are different from the aforementioned time span, the specified validity periods shall prevail)
